In many home repair contracts, the contractor would insert a provision allowing them to collect attorney’s fees if they were successful in asserting a claim against the homeowner in court. The same was not true for the homeowner, unless it was expressly stated in the contract.

For any home repair and remodeling contract that is subject to the Home Repair and Remodeling Act that was signed on or after August 1, 2025, this is no longer the case. The Home Repair and Remodeling Act now provides that if one of the parties can be awarded reasonable attorney’s fees under the terms of the contract, this provision applies to all parties to the contract.
