Illinois amended the Probate Act of 1975 to help the administration of small estates in Illinois.

The Small Estate Affidavit permits a person to transfer their loved one’s tangible and intangible assets without the need for probate. Before August 15, 2025, the assets could not exceed $100,000, including any vehicle owned at the time of death.

As of August 15, 2025, the small estate limit is now $150,000 and does not include the value of any vehicles owned at the time of death.
